PURCHASE NECESSARY. No purchase or payment of any
money is necessary to enter this sweepstakes.
TO
ENTER: You may enter
the sweepstakes by submitting an entry form at http://www.respond1.com/emxinc/sensors/datasheet.html:
including your name, company, title, address, city, state, zip
code, daytime telephone number, and e-mail address. All
sweepstake entries must be submitted and received by December
30, 2003 at 5:00 p.m. Eastern Standard Time. One entry per
person and per E-mail address. EMX Industries is not
responsible for entries that are lost, late, delayed, garbled,
illegible, misdirected or misrouted as a result of
interrupted, unavailable, disrupted network, server, computer,
telephone, cable or phone line connections, Internet
transmissions, software or hardware malfunctions or for any
failure, error or problem of any kind whether mechanical,
human or electronic. Sweepstakes begins on September 1, 2003.
All entries become the property of EMX Industries and
will not be returned.
PRIZE
DETAILS:
The winner will receive a Sony SJ22 CLIÉ handheld or
equivalent. Approximate retail value of
$180. No
substitutions, cash equivalents or transfers of prizes
permitted.
DRAWING
AND AWARDING OF PRIZE:
Eligible entries for the prize
will be entered in a drawing from which winners will be chosen
at random in a drawing to be held on or about January 15,
2004. Drawing and awarding of prizes will be handled by EMX
Industries, whose decisions are final on all matters
pertaining to this sweepstakes. Prize winner will be notified
by e-mail, telephone or mail. Prize winner may be required to
complete and return an Affidavit of Eligibility, Liability
Release, and Publicity Release to be returned within 14 days
of date notice is sent or date set by sponsor or prize will be
forfeited and may be awarded to an alternate winner. If prize,
prize notification or attempted notification is returned as
undeliverable, prize will be forfeited and may be awarded to
an alternate winner. Unclaimed prize may not be awarded.
ODDS:
Odds of winning depend on the number of eligible
entries received.
ELIGIBILITY:
Sweepstakes are open to all legal United States
residents (excluding Puerto Rico and other U.S. territories),
18 years of age and older as of September 1, 2003. Winner's
name and likeness may be used for publicity purposes without
further compensation except where prohibited. Employees and
families of EMX Industries and it affiliates, divisions
and related companies, advertising and promotional agencies
are not eligible. Void where prohibited or restricted. All
federal, state and local taxes, license and registration fees,
if any, shall be the sole responsibility of the winner. EMX
Industries is not responsible for technical or human
errors, which may occur while processing submissions, which
may damage a user's system or limit a participant's ability to
participate in the sweepstakes.
ADDITIONAL
CONDITIONS OF PARTICIPATION. By
submitting an entry, participant agrees to all of the terms
and conditions of these rules and to the decisions of the
sweepstakes judges, whose decisions shall be final and legally
binding in all matters relating to the sweepstakes.
Participant waives the right to assert as a cost of winning
any prize, any and all costs of verification and redemption or
travel to redeem a prize and any liability that might arise
from redeeming or seeking to redeem a prize. By participating
and redeeming a prize, participant releases sponsor and its
affiliates, subsidiaries, successors, assigns, licensees,
franchisees, and advertising, promotional or judging agencies
and the respective officers, directors, employees, and agents
of each of them, from any and all liability, claims, or
actions of any kind whatsoever for injuries, damages or losses
to persons and property, including death and bodily injury,
which may be sustained in connection with the participation in
the sweepstakes or the receipt, ownership or use of any prize.
Any disputes, claims and causes of action arising out of or
connected with this sweepstakes, or any prizes awarded, shall
be resolved individually, without resort to any form of class
action, exclusively by arbitration in Chicago, IL pursuant to
the rules of the American Arbitration Association then in
effect and applying Illinois law and subject to any limitation
of liability set forth in these sweepstakes rules. Any
arbitration award shall be limited to participant's actual
out-of-pocket expenses incurred, if any, and in no event shall
participant be entitled to any indirect, special,
consequential, exemplary, punitive or multiple damages or loss
of business or profits, or recovery of attorneys' fees.
Sponsor reserves the right to cancel and revoke this
sweepstakes due to printing errors or other mistakes in
sponsor's sole discretion. Sponsor cannot accept
correspondence or telephone inquiries regarding the status of
entries.
